Terms of Service

1. About these terms
These terms of service (“Terms”) form a legally binding contract between Ascend Tuition Ltd, a company registered in England and Wales (company number [COMPANY NUMBER], registered office [REGISTERED ADDRESS]) (“we”, “us”, “our”) and you, the parent or carer who books tuition for a student.
You accept these Terms when you tick the acceptance box during booking or otherwise confirm a booking with us. We recommend you save or print a copy. “Student” means the child receiving tuition. You confirm that you have parental responsibility for the Student, or the consent of someone who does, and that you are at least 18 years old.
2. Our service
We provide online one-to-one GCSE tutoring delivered by Enhanced-DBS-checked tutors through Google Meet, together with a parent portal, personalised learning plans, homework and progress reporting, as described on our website at the time of booking. Lessons are delivered online only. Lessons are not recorded.
3. Booking and the initial assessment
- Tuition begins with a free consultation and, where you choose to proceed, an initial assessment lesson at the price shown on our website.
- A contract is formed when we confirm your booking by email.
- Following the assessment, we will recommend a package. You are never obliged to purchase a package, and we will never charge you for anything you have not agreed to.
4. Fees and payment
- Fees are as published on our website at the time you book. Package fees are payable monthly in advance by card through Stripe, our payment processor.
- Your billing date is the calendar day of your first package purchase, and payment is collected monthly on that day (or the nearest available day in shorter months).
- If a payment fails, we will notify you and retry. We may pause lessons until payment is received. Amounts unpaid for more than 14 days may incur our reasonable costs of recovery.
- We may change our prices by giving you at least one month's written notice. A price change never applies to a period you have already paid for, and you may cancel under clause 7 before the change takes effect.
5. Cancelling and rescheduling lessons
- You may reschedule any lesson free of charge by giving us at least 48 hours' notice through the parent portal or by email to info@ascendtuition.co.uk.
- A lesson cancelled with less than 48 hours' notice, or where the Student does not attend, is charged in full — except where we agree the absence was caused by illness or emergency, in which case we will offer a make-up lesson where reasonably possible.
- If a tutor cancels a lesson, we will offer a replacement lesson or a substitute tutor at no extra cost, or credit the lesson to your account. You will never lose a lesson because of a cancellation by us.
- Lessons start and finish at the scheduled times. If the Student joins late, the lesson still finishes at the scheduled time.
6. Your legal right to cancel (cooling-off period)
Because you buy our services online, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 give you the right to cancel this contract within 14 days of the day we confirm your booking, without giving any reason, for a full refund. We voluntarily extend this to 15 days.
If you ask us to begin lessons within this period, you agree that: (a) if you cancel within the period, you will pay only for the lessons delivered up to the point of cancellation and we will refund the rest; and (b) if all lessons in the package are delivered within the period, the right to cancel is lost. To cancel, email info@ascendtuition.co.uk with your name and booking details. A clear statement that you wish to cancel is sufficient.
7. Ending an ongoing package
- Monthly packages continue month to month until cancelled. There is no minimum term.
- You may cancel at any time, free of charge, by emailing info@ascendtuition.co.uk at least 15 days before your next billing date. Your package then ends at the end of the period you have already paid for, and no further payments are taken.
- If you cancel with fewer than 15 days before your next billing date, the cancellation takes effect at the end of the following billing period, and lessons already paid for remain available to use.
- We may end the contract with one month's written notice. We may end it immediately if you materially breach these Terms, behave abusively towards a tutor or member of staff, or payment remains outstanding for more than 30 days. If we end the contract other than for your breach, we will refund all lessons you have paid for but not received.
8. What we need from you
- Provide accurate information about the Student's ability, needs and exam board;
- Ensure the Student has a suitable device, a stable internet connection and a quiet space for lessons;
- Ensure a parent or responsible adult is at home during lessons, in line with our Safeguarding & Child Protection Policy;
- Treat tutors with courtesy and raise any concerns with us promptly.
9. Progress and results
We will provide structured, exam-focused tuition with reasonable care and skill, and we work to maximise every student's progress. Exam results, however, depend on many factors outside our control, including the Student's own effort and attendance. We do not guarantee any particular grade or outcome, and nothing on our website or in our communications is a promise of specific results.
10. Tutors and non-solicitation
- We select the tutor best suited to the Student and may substitute an equally qualified, Enhanced-DBS-checked tutor where necessary. You may request a change of tutor at any time.
- Our tutors are engaged and paid by us. During your contract and for 12 months after it ends, you agree not to engage any Ascend Tuition tutor privately, directly or indirectly, other than through us. If you do, you agree to pay us an introduction fee of £500, which the parties agree is a genuine pre-estimate of our loss in recruiting, vetting and training that tutor.
11. Intellectual property
All learning materials, plans and resources we provide remain our property or that of our licensors. They are licensed to you for the Student's personal study only and must not be copied, shared, published or sold.
12. Our liability
- Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded by law.
- Subject to clause 12.1, our total liability to you in connection with this contract is limited to the fees you paid us in the 12 months before the event giving rise to the claim.
- We are not responsible for delay or failure caused by events outside our reasonable control (such as internet or platform outages or tutor illness), but we will always seek to rearrange affected lessons and clause 5.3 applies to lessons we cancel.
- Nothing in these Terms affects your statutory rights as a consumer, including your right under the Consumer Rights Act 2015 to services performed with reasonable care and skill, within a reasonable time, and to appropriate remedies if they are not.
13. Data protection
We handle personal data — including the Student's data — in accordance with our Privacy Policy, which explains what we collect, why, and your rights. Our Privacy Policy and Safeguarding & Child Protection Policy form part of these Terms.
14. Complaints
If something is not right, email info@ascendtuition.co.uk. We will acknowledge your complaint within 2 working days and aim to resolve it within 14 days. Making a complaint does not affect your legal rights, including your right to bring a claim or to complain to Trading Standards or Citizens Advice.
15. General
- Changes to these Terms. We may update these Terms. Changes apply to new bookings immediately and, for ongoing packages, take effect after one month's written notice. If you do not accept a change, you may cancel under clause 7 before it takes effect, and clause 7.2's notice period will be waived for that cancellation.
- Notices. We will contact you using the email address on your account. You can contact us at info@ascendtuition.co.uk.
- Severability. If any part of these Terms is found to be unenforceable, the rest remains in force.
- Third parties. This contract is between you and us; no one else has rights under it (Contracts (Rights of Third Parties) Act 1999).
- Governing law. These Terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live in Scotland or Northern Ireland, you may also bring proceedings in your local courts.
